1. About These Terms

These Terms of Service ("Terms") govern your use of the GoGoCash service, including our website (gogocash.co), mobile applications, browser extensions, and any related features such as the optional GoGoSense feature (collectively, the "Service").

The Service is operated by ห้างหุ้นส่วนจำกัด โกโกโฮลดิ้ง ประเทศไทย / GOGO HOLDING Thailand Limited Partnership ("GoGoCash", "we", "our", "us"), a limited partnership registered in Thailand.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms replace and supersede any previous "Terms of Service" or "Terms of Use" published at gogocash.co.

2. Definitions

  • "Account" means your GoGoCash user account.
  • "Affiliate Network" means our third-party reconciliation partners, currently Involve Asia, Optimise, and TikTok Shop CPS, who attribute and confirm Eligible Purchases.
  • "Cashback" means the rewards you can earn through the Service, denominated in Thai Baht.
  • "ClickID" means the opaque session identifier generated when you activate Cashback for a Partner session.
  • "Eligible Purchase" means a transaction completed at a Partner during a valid Cashback activation session that is confirmed by the relevant Affiliate Network.
  • "GoGoSense" means our optional Android-only feature that detects, on your device, when you open a Partner app and prompts you to activate Cashback.
  • "Partner" means a third-party retailer or service provider participating in the Cashback program, including Shopee, Lazada, TikTok Shop, Agoda, and Klook.
  • "User", "you", and "your" means an individual using the Service.

3. Eligibility and Account

To use the Service, you must:

  1. Be at least 18 years of age and legally capable of entering into a binding contract under Thai law;
  2. Provide accurate registration information, including a valid Thai mobile number or email address;
  3. Maintain only one Account per person; and
  4. Keep your account credentials confidential. You are responsible for activity under your Account.

We may verify your identity at any time as required by applicable law (including anti-money-laundering rules) or to investigate suspected fraud.

4. The GoGoCash Service

GoGoCash is a multi-brand cashback platform. When you complete an Eligible Purchase at a Partner through the Service, the Partner pays us a commission via an Affiliate Network, and we credit a portion of that commission to your Account as Cashback.

We do not sell, ship, or fulfill Partner products. Partners are independent businesses solely responsible for their products, services, prices, delivery, refunds, returns, and customer support. Any dispute arising from a Partner transaction is between you and the Partner.

5. The Cashback Program

5.1 How Cashback is Earned

  • You activate a Cashback session for a Partner through the Service (either manually in the app, or via GoGoSense if you have enabled it).
  • You complete a purchase at that Partner during the active session.
  • The Partner reports the transaction to the relevant Affiliate Network.
  • The Affiliate Network confirms the transaction is an Eligible Purchase and pays commission to GoGoCash, typically within 30 to 90 days of purchase.
  • Once confirmed, we credit the corresponding Cashback to your Account.

5.2 Cashback Rates

Cashback rates per Partner are displayed in the Service and may change at our discretion or at the Partner's request. The rate applicable to your Eligible Purchase is the rate displayed at the time you activated the Cashback session.

5.3 Pending and Confirmed Cashback

Cashback first appears in your Account as "Pending" once the session is activated and the Partner reports the transaction. It becomes "Confirmed" once the Affiliate Network completes reconciliation. Only Confirmed Cashback may be withdrawn.

5.4 Cancelled, Returned, or Refunded Purchases

If a purchase is cancelled, returned, refunded, or otherwise reversed by the Partner, the corresponding Cashback will be reversed. If the Cashback has already been withdrawn, the resulting negative balance may be deducted from future Cashback.

5.5 Minimum Withdrawal and Payout

  • The minimum withdrawal threshold is THB 100, or such amount as displayed in the Service.
  • Withdrawals are paid to your verified bank account, PromptPay account, or e-wallet, as available in the Service.
  • We may delay or hold a withdrawal pending verification, fraud checks, or compliance review.

5.6 Inactive Accounts

If your Account has had no log-in or qualifying activity for 24 consecutive months, we may notify you and, after a further 60 days of inactivity, close the Account and forfeit any unwithdrawn Cashback, to the extent permitted by Thai law.

6. GoGoSense (Optional Feature)

6.1 What GoGoSense Does

GoGoSense is an optional, Android-only feature that detects, on your device, when you open a Partner shopping app and prompts you to activate Cashback in one tap. Detection uses the Android Usage Access permission (PACKAGE_USAGE_STATS), which you grant manually in your device Settings.

6.2 Cashback Is Not Conditional on GoGoSense

Your decision to enable GoGoSense has no effect on the Cashback or rewards you earn. You may use the entire Cashback program without enabling GoGoSense by activating Cashback manually in the app. We will not reduce, withhold, or condition any reward on your decision to enable, refuse, or revoke GoGoSense.

6.3 What GoGoSense Sees and Sends

GoGoSense detects the foreground app on your device only to match it against our list of Partners. It does not read your screen content, keystrokes, browsing history, messages, or the content of any Partner app. When you choose to activate Cashback, the only information sent to our servers is an internal Partner identifier (for example, "shopee_th"), a session identifier, and a timestamp. Detailed handling of your personal data is described in our Privacy Policy.

6.4 Turning GoGoSense Off

You can disable GoGoSense at any time by:

  • toggling it off in the app under Settings → GoGoSense;
  • revoking Usage Access in Android Settings → Apps with usage access; or
  • deleting your Account.

Disabling GoGoSense is free, takes effect immediately, and does not affect Cashback you have already earned.

6.5 No iOS Version

GoGoSense is currently Android-only. We do not promise an iOS version. If we release one, it will operate under different technical constraints, and the Terms applicable to it will be made available at that time.

7. Affiliate Partners

To attribute and pay your Cashback, we work with the Affiliate Networks listed in Section 2. When you activate Cashback, we share an opaque ClickID with the relevant Affiliate Network and, where applicable, the Partner. We do not share your name, email, phone number, device identifier, or any other personal data with these networks for the purpose of attribution. They use the ClickID only to match a qualifying purchase back to GoGoCash so your Cashback can be reconciled.

8. Acceptable Use

You agree not to:

  1. Use the Service to commit fraud, including by self-purchasing through your own Cashback link to generate rewards;
  2. Use bots, scripts, scrapers, or automated means to interact with the Service or its Partners;
  3. Create multiple Accounts or impersonate another person;
  4. Manipulate or attempt to reverse-engineer the attribution, reconciliation, or detection systems;
  5. Use the Service in violation of Thai law, including the Personal Data Protection Act B.E. 2562 and the Computer-Related Crime Act;
  6. Resell, sublicense, or commercially exploit the Service or its data; or
  7. Interfere with the security or integrity of the Service.

9. Fraud Prevention and Account Suspension

We may, at our reasonable discretion and on notice where practicable, suspend, restrict, or close your Account, void Pending or Confirmed Cashback, or reverse a withdrawal where we have a reasonable basis to believe you have engaged in fraud, abuse, or a material breach of these Terms. Where we close an Account for fraud, we may retain transaction records as required by anti-money-laundering and tax laws.

10. Intellectual Property

The Service, including its software, designs, text, graphics, logos, and trade marks, is owned by GoGoCash or its licensors and is protected by Thai and international law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You retain ownership of content you submit to the Service, and grant us a worldwide, royalty-free licence to use that content as necessary to operate the Service.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we handle your personal data in compliance with the Thailand Personal Data Protection Act B.E. 2562. By using the Service, you acknowledge the Privacy Policy. Consent to specific data processing (including GoGoSense) is collected separately, in the app.

12. Changes to These Terms

We may amend these Terms from time to time. Material changes will be notified to you at least 14 days before they take effect, by email, in-app notice, or both. Continued use of the Service after the effective date of the amended Terms constitutes acceptance. If you do not agree to the amended Terms, you may close your Account.

13. Termination

  • By you: You may close your Account at any time in the Service. On closure, any Confirmed Cashback above the withdrawal threshold will be paid to your verified withdrawal method, less any reversed or fraudulent amounts.
  • By us: We may terminate your access for material breach, fraud, regulatory reasons, or after 24 months of inactivity as described in Section 5.6. Termination does not extinguish your statutory rights under the Personal Data Protection Act B.E. 2562.

14. Disclaimers

To the maximum extent permitted by Thai law:

  • The Service is provided "as is" and "as available";
  • We do not warrant that Cashback rates, Partner availability, or detection accuracy will be uninterrupted, error-free, or unchanged;
  • We do not warrant any Partner's products, services, prices, delivery, or refund policies;
  • Cashback is a marketing reward and does not constitute a security, financial instrument, or store of value;
  • We are not a payment service provider, money remitter, or licensed financial institution.

15. Limitation of Liability

To the maximum extent permitted by Thai law, our total aggregate liability to you arising out of or in connection with the Service, the Cashback program, or these Terms is limited to the greater of:

(a) the total Cashback paid to your Account in the 12 months preceding the event giving rise to the claim; or (b) THB 10,000.

Nothing in this Section limits liability that cannot be excluded under Thai consumer protection law, the Personal Data Protection Act B.E. 2562, or for fraud or wilful misconduct.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of goodwill, or loss of data.

16. Indemnification

You agree to indemnify and hold GoGoCash harmless against any claim arising from your breach of these Terms, your misuse of the Service, your violation of law, or your interaction with any Partner, except to the extent caused by our wilful misconduct or gross negligence.

17. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand. Disputes will be submitted to the exclusive jurisdiction of the Thai courts, subject to your statutory rights as a consumer under Thai law. We encourage you to contact us first at support@gogocash.co so that we can attempt to resolve any concern amicably.

18. Miscellaneous

  • Assignment: You may not assign your rights or obligations under these Terms. We may assign these Terms to an affiliate or successor in connection with a corporate transaction.
  • Severability: If any provision of these Terms is held unenforceable, the remainder remains in full force.
  • No waiver: Our failure to enforce a right is not a waiver of that right.
  • Entire agreement: These Terms, together with the Privacy Policy and any in-app disclosures, constitute the entire agreement between you and GoGoCash regarding the Service.
  • Language: These Terms are published in English and Thai. In the event of any inconsistency, the Thai version prevails for users resident in Thailand.

2. คำนิยาม

  • "บัญชี" หมายถึง บัญชีผู้ใช้ GoGoCash ของคุณ
  • "เครือข่ายพันธมิตร" หมายถึง พันธมิตรกระทบยอดของเรา ซึ่งปัจจุบันได้แก่ Involve Asia, Optimise และ TikTok Shop CPS ที่ทำหน้าที่ระบุแหล่งที่มาและยืนยันการซื้อที่เข้าเงื่อนไข
  • "เงินคืน" หมายถึง รางวัลที่คุณสามารถได้รับผ่านบริการ คำนวณเป็นเงินบาท
  • "ClickID" หมายถึง รหัสเซสชันแบบไม่ระบุตัวตนที่สร้างขึ้นเมื่อคุณเปิดใช้งานเงินคืนสำหรับเซสชันของพันธมิตร
  • "การซื้อที่เข้าเงื่อนไข" หมายถึง ธุรกรรมที่เสร็จสมบูรณ์ที่ร้านพันธมิตรในระหว่างเซสชันการเปิดใช้งานเงินคืนที่ถูกต้อง และได้รับการยืนยันโดยเครือข่ายพันธมิตรที่เกี่ยวข้อง

3. คุณสมบัติและบัญชี

ในการใช้บริการ คุณต้อง:

  1. มีอายุไม่ต่ำกว่า 18 ปี และมีความสามารถตามกฎหมายไทยในการเข้าทำสัญญาที่มีผลผูกพัน
  2. ให้ข้อมูลการลงทะเบียนที่ถูกต้อง รวมถึงหมายเลขโทรศัพท์มือถือไทยหรืออีเมลที่ใช้งานได้
  3. มีบัญชีเพียงหนึ่งบัญชีต่อหนึ่งบุคคล และ
  4. รักษาข้อมูลรับรองบัญชีของคุณเป็นความลับ คุณรับผิดชอบต่อกิจกรรมที่เกิดขึ้นภายใต้บัญชีของคุณ

เราอาจยืนยันตัวตนของคุณได้ตลอดเวลาตามที่กฎหมายกำหนด (รวมถึงกฎหมายป้องกันการฟอกเงิน) หรือเพื่อสอบสวนการฉ้อโกงที่ต้องสงสัย

4. บริการ GoGoCash

GoGoCash เป็นแพลตฟอร์มเงินคืนหลายแบรนด์ เมื่อคุณทำการซื้อที่เข้าเงื่อนไขที่ร้านพันธมิตรผ่านบริการ พันธมิตรจะจ่ายค่าคอมมิชชันให้เราผ่านเครือข่ายพันธมิตร และเราจะให้เครดิตส่วนหนึ่งของค่าคอมมิชชันนั้นเข้าบัญชีของคุณเป็นเงินคืน

เราไม่ได้ขาย จัดส่ง หรือจัดการสินค้าของพันธมิตร พันธมิตรเป็นธุรกิจอิสระที่รับผิดชอบโดยลำพังต่อสินค้า บริการ ราคา การจัดส่ง การคืนเงิน การรับคืน และการดูแลลูกค้าของตน ข้อพิพาทใด ๆ ที่เกิดจากธุรกรรมกับพันธมิตรเป็นเรื่องระหว่างคุณกับพันธมิตร

5. โปรแกรมเงินคืน

5.1 การได้รับเงินคืน

  • คุณเปิดใช้งานเซสชันเงินคืนสำหรับพันธมิตรผ่านบริการ (ด้วยตนเองในแอป หรือผ่าน GoGoSense หากคุณเปิดใช้งาน)
  • คุณทำการซื้อที่พันธมิตรนั้นในระหว่างเซสชันที่ใช้งานอยู่
  • พันธมิตรรายงานธุรกรรมให้เครือข่ายพันธมิตรที่เกี่ยวข้อง
  • เครือข่ายพันธมิตรยืนยันว่าธุรกรรมเป็นการซื้อที่เข้าเงื่อนไข และจ่ายค่าคอมมิชชันให้ GoGoCash โดยปกติภายใน 30 ถึง 90 วันนับจากวันที่ซื้อ
  • เมื่อได้รับการยืนยันแล้ว เราจะให้เครดิตเงินคืนที่สอดคล้องเข้าบัญชีของคุณ

5.2 อัตราเงินคืน

อัตราเงินคืนของแต่ละพันธมิตรจะแสดงในบริการ และอาจมีการเปลี่ยนแปลงตามดุลยพินิจของเราหรือตามคำขอของพันธมิตร อัตราที่ใช้กับการซื้อที่เข้าเงื่อนไขของคุณคืออัตราที่แสดงในขณะที่คุณเปิดใช้งานเซสชันเงินคืน

5.3 เงินคืนที่รอดำเนินการและที่ยืนยันแล้ว

เงินคืนจะปรากฏในบัญชีของคุณเป็น "รอดำเนินการ" ในตอนแรก เมื่อเซสชันได้รับการเปิดใช้งานและพันธมิตรรายงานธุรกรรม จะกลายเป็น "ยืนยันแล้ว" เมื่อเครือข่ายพันธมิตรกระทบยอดเสร็จสมบูรณ์ เฉพาะเงินคืนที่ยืนยันแล้วเท่านั้นที่สามารถถอนได้

5.4 การยกเลิก การคืนสินค้า หรือการคืนเงิน

หากการซื้อถูกยกเลิก คืนสินค้า คืนเงิน หรือกลับรายการโดยพันธมิตร เงินคืนที่สอดคล้องจะถูกกลับรายการตามไปด้วย หากเงินคืนนั้นถูกถอนไปแล้ว ยอดติดลบที่เกิดขึ้นอาจถูกหักจากเงินคืนในอนาคต

5.5 ยอดถอนขั้นต่ำและการจ่ายเงิน

  • ยอดถอนขั้นต่ำคือ 100 บาท หรือยอดที่แสดงในบริการ
  • การถอนจะจ่ายเข้าบัญชีธนาคาร บัญชี PromptPay หรือ e-wallet ที่ได้รับการยืนยันของคุณ ตามที่บริการเปิดให้ใช้งาน
  • เราอาจหน่วงเวลาหรือระงับการถอนระหว่างรอการยืนยัน การตรวจสอบการฉ้อโกง หรือการทบทวนเพื่อปฏิบัติตามกฎระเบียบ

5.6 บัญชีที่ไม่มีการเคลื่อนไหว

หากบัญชีของคุณไม่มีการเข้าสู่ระบบหรือกิจกรรมที่เข้าเงื่อนไขเป็นเวลา 24 เดือนติดต่อกัน เราอาจแจ้งให้คุณทราบ และหลังจากไม่มีการเคลื่อนไหวต่ออีก 60 วัน อาจปิดบัญชีและริบเงินคืนที่ยังไม่ได้ถอน เท่าที่กฎหมายไทยอนุญาต

6. GoGoSense (ฟีเจอร์เสริม)

6.1 สิ่งที่ GoGoSense ทำ

GoGoSense เป็น ฟีเจอร์เสริมสำหรับระบบ Android เท่านั้น ที่ตรวจจับ บนอุปกรณ์ของคุณ ว่าคุณเปิดแอปพันธมิตรเมื่อใด และแสดงข้อความให้คุณเปิดใช้งานเงินคืนได้ด้วยการแตะเพียงครั้งเดียว การตรวจจับใช้สิทธิ์ การเข้าถึงการใช้งาน (Usage Access) ของ Android (PACKAGE_USAGE_STATS) ซึ่งคุณเป็นผู้ให้สิทธิ์ด้วยตนเองในการตั้งค่าของอุปกรณ์

6.2 เงินคืนไม่ขึ้นอยู่กับ GoGoSense

การตัดสินใจเปิดใช้งาน GoGoSense ของคุณไม่มีผลต่อเงินคืนหรือรางวัลที่คุณได้รับ คุณสามารถใช้โปรแกรมเงินคืนทั้งหมดได้โดยไม่ต้องเปิดใช้งาน GoGoSense โดยการเปิดใช้งานเงินคืนด้วยตนเองในแอป เราจะไม่ลด ระงับ หรือกำหนดเงื่อนไขรางวัลใด ๆ โดยอ้างอิงกับการตัดสินใจเปิดใช้งาน ปฏิเสธ หรือเพิกถอน GoGoSense ของคุณ

6.3 สิ่งที่ GoGoSense เห็นและส่ง

GoGoSense ตรวจจับแอปที่แสดงเบื้องหน้าบนอุปกรณ์ของคุณเพียงเพื่อจับคู่กับรายการพันธมิตรของเราเท่านั้น โดย ไม่ อ่านเนื้อหาหน้าจอ การพิมพ์ ประวัติการเข้าเว็บ ข้อความ หรือเนื้อหาภายในแอปพันธมิตรใด ๆ เมื่อคุณเลือกเปิดใช้งานเงินคืน ข้อมูลเดียวที่ส่งไปยังเซิร์ฟเวอร์ของเราคือรหัสพันธมิตรภายใน (เช่น "shopee_th") รหัสเซสชัน และการประทับเวลา การจัดการข้อมูลส่วนบุคคลของคุณอย่างละเอียดอธิบายไว้ในนโยบายความเป็นส่วนตัวของเรา

6.4 การปิด GoGoSense

คุณสามารถปิด GoGoSense ได้ตลอดเวลาโดย:

  • เพิกถอน Usage Access ใน การตั้งค่า Android → แอปที่มีสิทธิ์เข้าถึงการใช้งาน หรือ
  • ลบบัญชีของคุณ

การปิด GoGoSense ไม่มีค่าใช้จ่าย มีผลทันที และไม่กระทบต่อเงินคืนที่คุณได้รับไปแล้ว

6.5 ไม่มีเวอร์ชัน iOS

ปัจจุบัน GoGoSense รองรับเฉพาะระบบ Android เท่านั้น เราไม่ได้ให้คำมั่นว่าจะมีเวอร์ชัน iOS หากเราเปิดตัว เวอร์ชันนั้นจะทำงานภายใต้ข้อจำกัดทางเทคนิคที่แตกต่างออกไป และจะมีการเผยแพร่เงื่อนไขที่ใช้บังคับในขณะนั้น

7. เครือข่ายพันธมิตร

เพื่อระบุแหล่งที่มาและจ่ายเงินคืนของคุณ เราทำงานร่วมกับเครือข่ายพันธมิตรที่ระบุไว้ในข้อ 2 เมื่อคุณเปิดใช้งานเงินคืน เราแบ่งปัน ClickID แบบไม่ระบุตัวตน กับเครือข่ายพันธมิตรที่เกี่ยวข้อง และในกรณีที่เกี่ยวข้อง กับพันธมิตรด้วย เราไม่แบ่งปันชื่อ อีเมล หมายเลขโทรศัพท์ รหัสอุปกรณ์ หรือข้อมูลส่วนบุคคลอื่นใดของคุณกับเครือข่ายเหล่านี้ เพื่อวัตถุประสงค์ในการระบุแหล่งที่มา พวกเขาใช้ ClickID เพียงเพื่อจับคู่การซื้อที่เข้าเงื่อนไขกลับมายัง GoGoCash เพื่อให้สามารถกระทบยอดเงินคืนของคุณได้

8. การใช้งานที่ยอมรับได้

คุณตกลงที่จะไม่:

  1. ใช้บริการเพื่อกระทำการฉ้อโกง รวมถึงการซื้อเองผ่านลิงก์เงินคืนของคุณเพื่อสร้างรางวัล
  2. ใช้บอท สคริปต์ เครื่องมือ Scrape หรือวิธีการอัตโนมัติในการโต้ตอบกับบริการหรือพันธมิตร
  3. สร้างบัญชีหลายบัญชีหรือแอบอ้างเป็นบุคคลอื่น
  4. ดัดแปลงหรือพยายามทำวิศวกรรมย้อนกลับระบบการระบุแหล่งที่มา การกระทบยอด หรือการตรวจจับ
  5. ใช้บริการในลักษณะที่ฝ่าฝืนกฎหมายไทย รวมถึงพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 และพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์
  6. ขายต่อ ให้อนุญาตช่วง หรือแสวงหาประโยชน์เชิงพาณิชย์จากบริการหรือข้อมูลของบริการ หรือ
  7. รบกวนความปลอดภัยหรือความสมบูรณ์ของบริการ

9. การป้องกันการฉ้อโกงและการระงับบัญชี

เราอาจระงับ จำกัด หรือปิดบัญชีของคุณ ยกเลิกเงินคืนที่รอดำเนินการหรือที่ยืนยันแล้ว หรือกลับรายการการถอน ตามดุลยพินิจที่สมเหตุสมผลของเรา โดยการแจ้งให้ทราบล่วงหน้าหากสามารถกระทำได้ ในกรณีที่เรามีเหตุผลอันสมควรที่จะเชื่อว่าคุณได้กระทำการฉ้อโกง การใช้ในทางมิชอบ หรือการละเมิดเงื่อนไขนี้อย่างมีนัยสำคัญ ในกรณีที่เราปิดบัญชีเนื่องจากการฉ้อโกง เราอาจเก็บบันทึกธุรกรรมตามที่กฎหมายป้องกันการฟอกเงินและกฎหมายภาษีกำหนด

10. ทรัพย์สินทางปัญญา

บริการ ซึ่งรวมถึงซอฟต์แวร์ การออกแบบ ข้อความ กราฟิก โลโก้ และเครื่องหมายการค้า เป็นของ GoGoCash หรือผู้ให้สิทธิ์ของเรา และได้รับการคุ้มครองโดยกฎหมายไทยและกฎหมายระหว่างประเทศ เราให้สิทธิ์การใช้งานบริการแก่คุณอย่างจำกัด ส่วนบุคคล ไม่สามารถโอนได้ และเพิกถอนได้ เพื่อวัตถุประสงค์ที่ตั้งใจไว้ คุณยังคงเป็นเจ้าของเนื้อหาที่คุณส่งไปยังบริการ และให้สิทธิ์เราในการใช้เนื้อหานั้นทั่วโลก โดยไม่มีค่าลิขสิทธิ์ เท่าที่จำเป็นในการดำเนินบริการ

11. ความเป็นส่วนตัว

การใช้บริการของคุณยังอยู่ภายใต้ นโยบายความเป็นส่วนตัว ของเรา ซึ่งอธิบายวิธีที่เราจัดการข้อมูลส่วนบุคคลของคุณ ตามที่กำหนดในพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 การใช้บริการถือว่าคุณรับทราบนโยบายความเป็นส่วนตัว ความยินยอมสำหรับการประมวลผลข้อมูลเฉพาะ (รวมถึง GoGoSense) จะถูกขอแยกต่างหากในแอป

12. การเปลี่ยนแปลงเงื่อนไข

เราอาจแก้ไขเงื่อนไขนี้เป็นครั้งคราว การเปลี่ยนแปลงที่เป็นสาระสำคัญจะแจ้งให้คุณทราบล่วงหน้าอย่างน้อย 14 วันก่อนมีผลบังคับใช้ ผ่านอีเมล การแจ้งเตือนในแอป หรือทั้งสองอย่าง การใช้บริการต่อไปหลังวันที่มีผลบังคับใช้ของเงื่อนไขที่แก้ไขถือว่ายอมรับ หากคุณไม่ตกลงตามเงื่อนไขที่แก้ไข คุณสามารถปิดบัญชีของคุณได้

13. การสิ้นสุด

  • โดยคุณ: คุณสามารถปิดบัญชีของคุณได้ตลอดเวลาในบริการ เมื่อปิดบัญชี เงินคืนที่ยืนยันแล้วซึ่งเกินยอดถอนขั้นต่ำจะถูกจ่ายไปยังวิธีการถอนที่ได้รับการยืนยันของคุณ หักจำนวนที่ถูกกลับรายการหรือฉ้อโกง
  • โดยเรา: เราอาจยุติการเข้าถึงของคุณกรณีละเมิดอย่างมีนัยสำคัญ การฉ้อโกง เหตุผลด้านกฎระเบียบ หรือหลังจากไม่มีการเคลื่อนไหว 24 เดือนตามที่อธิบายไว้ในข้อ 5.6 การสิ้นสุดไม่ระงับสิทธิตามกฎหมายของคุณภายใต้พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562

14. ข้อยกเว้นความรับผิด

เท่าที่กฎหมายไทยอนุญาต:

  • บริการนี้ให้ "ตามที่เป็น" และ "ตามที่มี"
  • เราไม่รับประกันว่าอัตราเงินคืน การมีพันธมิตรอยู่ หรือความแม่นยำของการตรวจจับจะไม่หยุดชะงัก ปราศจากข้อผิดพลาด หรือไม่มีการเปลี่ยนแปลง
  • เราไม่รับประกันสินค้า บริการ ราคา การจัดส่ง หรือนโยบายการคืนเงินของพันธมิตรใด ๆ
  • เงินคืนเป็นรางวัลทางการตลาด ไม่ใช่หลักทรัพย์ เครื่องมือทางการเงิน หรือสื่อกลางเก็บมูลค่า
  • เราไม่ใช่ผู้ให้บริการชำระเงิน ผู้โอนเงิน หรือสถาบันการเงินที่ได้รับใบอนุญาต

15. การจำกัดความรับผิด

เท่าที่กฎหมายไทยอนุญาต ความรับผิดรวมสูงสุดของเราต่อคุณที่เกิดจากหรือเกี่ยวข้องกับบริการ โปรแกรมเงินคืน หรือเงื่อนไขนี้ จำกัดไว้ที่จำนวนที่สูงกว่าระหว่าง:

(ก) เงินคืนรวมที่จ่ายเข้าบัญชีของคุณใน 12 เดือนก่อนเหตุการณ์ที่ก่อให้เกิดข้อเรียกร้อง หรือ (ข) 10,000 บาท

ไม่มีข้อใดในข้อนี้จำกัดความรับผิดที่ไม่อาจยกเว้นได้ภายใต้กฎหมายคุ้มครองผู้บริโภคของไทย พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 หรือกรณีการฉ้อโกงหรือการประพฤติผิดโดยจงใจ

เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายโดยบังเอิญ ความเสียหายพิเศษ ความเสียหายต่อเนื่อง หรือความเสียหายเชิงลงโทษ การสูญเสียกำไร การสูญเสียค่าความนิยม หรือการสูญเสียข้อมูล

16. การชดใช้

คุณตกลงชดใช้และปกป้อง GoGoCash จากข้อเรียกร้องใด ๆ ที่เกิดจากการละเมิดเงื่อนไขนี้ของคุณ การใช้บริการในทางที่ผิดของคุณ การฝ่าฝืนกฎหมาย หรือการมีปฏิสัมพันธ์กับพันธมิตรใด ๆ ยกเว้นกรณีที่เกิดจากการประพฤติผิดโดยจงใจหรือความประมาทเลินเล่ออย่างร้ายแรงของเรา

17. กฎหมายที่ใช้บังคับและข้อพิพาท

เงื่อนไขนี้อยู่ภายใต้กฎหมายของราชอาณาจักรไทย ข้อพิพาทจะถูกส่งให้ศาลไทยพิจารณาในเขตอำนาจเด็ดขาด ภายใต้สิทธิตามกฎหมายของคุณในฐานะผู้บริโภคตามกฎหมายไทย เราขอเชิญให้คุณติดต่อเราก่อนที่ support@gogocash.co เพื่อให้เราพยายามแก้ไขข้อกังวลใด ๆ อย่างฉันมิตร

18. เบ็ดเตล็ด

  • การโอนสิทธิ์: คุณไม่อาจโอนสิทธิ์หรือหน้าที่ของคุณภายใต้เงื่อนไขนี้ เราอาจโอนเงื่อนไขนี้ให้แก่บริษัทในเครือหรือผู้รับช่วงต่อในกรณีที่มีธุรกรรมขององค์กร
  • การแยกส่วน: หากข้อใดในเงื่อนไขนี้ถูกพิจารณาว่าไม่สามารถบังคับใช้ได้ ส่วนที่เหลือยังคงมีผลบังคับใช้สมบูรณ์
  • ไม่ถือเป็นการสละสิทธิ์: การที่เราไม่บังคับใช้สิทธิ์ไม่ถือเป็นการสละสิทธิ์นั้น
  • ข้อตกลงทั้งหมด: เงื่อนไขนี้ ร่วมกับนโยบายความเป็นส่วนตัวและประกาศในแอป ถือเป็นข้อตกลงทั้งหมดระหว่างคุณและ GoGoCash เกี่ยวกับบริการ
  • ภาษา: เงื่อนไขนี้เผยแพร่เป็นภาษาอังกฤษและภาษาไทย หากมีความไม่สอดคล้องกัน ฉบับภาษาไทยจะมีผลเหนือกว่าสำหรับผู้ใช้ที่อาศัยอยู่ในประเทศไทย
